Kiogo Terms and Conditions of Service

Welcome to Kiogo. These Terms and Conditions govern access to and use of the website, the application and the related digital services offered by Favolandia.

By accessing or using our service, you declare that you have read, understood and agreed to be bound by these Terms. If you do not accept these conditions, please do not use the service.

1. Definitions

• Service: Refers to the Kiogo web/mobile application and platform dedicated to the management of after-school programs, summer camps and communication between educators and parents.
• User / Educator: The facility, the manager or the authorized staff who use the control panel for administrative management.
• Parent: The end user who accesses the application by PIN to view the student’s information.

2. Registration and Account

To use the advanced features of the Service, the User must register a facility by providing accurate, complete and up-to-date information (including the name of the facility, email address and contact details).

The User is responsible for the confidentiality of the login credentials and for all activities carried out under their account.

3. Trial Period and Subscriptions

• Free Trial: Each newly registered facility is entitled to a free trial period of 30 days starting from the registration date. During this period, all main features are accessible at no cost.
• Subscriptions and Renewals: At the end of the trial period, in order to continue using the Service, the User must take out a monthly subscription through the supported digital stores (Google Play Store, Apple App Store) or authorized payment systems.
• Management and Cancellation: Subscriptions renew automatically unless the User cancels directly through the settings of their store account (Google/Apple) or the dedicated customer portal, in compliance with the terms set by the third-party platforms.

4. Permanent Free Plans (Lifetime)

Any unlimited free plans ("Lifetime Free") granted at the discretion of Kiogo’s management to specific facilities remain active according to the agreed conditions, unless these Terms are violated or the service is discontinued.

5. Intellectual Property

All intellectual property rights relating to the Kiogo software (including source code, logos, graphics, trademarks and design) are the exclusive property of Fabrizio Di Marco / Favolandia. Unauthorized copying, reproduction, modification or distribution of any part of the software is expressly prohibited.

6. Limitation of Liability

The Service is provided "as is" and "as available". Kiogo does not guarantee that the platform will be free from errors or temporary interruptions.

Kiogo shall not be held liable for any indirect, incidental or consequential damages arising from the use of, or inability to use, the Service (including loss of data or interruptions to school/educational activities), except in cases of wilful misconduct or gross negligence.

7. Changes to the Terms

We reserve the right to modify or update these Terms and Conditions at any time. Changes will take effect immediately after being published on the website or in the application. Continued use of the Service after such changes constitutes acceptance of the new terms.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with Italian law. Any dispute arising from or connected with these terms shall be subject to the exclusive jurisdiction of the court of the place of residence or domicile of the owner, or of the court established by mandatory consumer protection rules where applicable.
